The National Center for Biomedical Ontology is a consortium that comprises leading informaticians, biologists, clinicians, and ontologists, funded by the National Institutes of Health (NIH) Roadmap, to develop innovative technology and methods that allow scientists to record, manage, and disseminate biomedical information and knowledge in machine-processable form. The goals of the Center are (1) to help unify the divergent and isolated efforts in ontology development by promoting high quality open-source, standards-based tools to create, manage, and use ontologies, (2) to create (...) new software tools so that scientists can use ontologies to annotate and analyze biomedical data, (3) to provide a national resource for the ongoing evaluation, integration, and evolution of biomedical ontologies and associated tools and theories in the context of driving biomedical projects (DBPs), and (4) to disseminate the tools and resources of the Center and to identify, evaluate, and communicate best practices of ontology development to the biomedical community. Through the research activities within the Center, collaborations with the DBPs, and interactions with the biomedical community, our goal is to help scientists to work more effectively in the e-science paradigm, enhancing experiment design, experiment execution, data analysis, information synthesis, hypothesis generation and testing, and understand human disease. This paper defines the form of prior knowledge that is required for sound inferences by analogy and single-instance generalizations, in both logical and probabilistic reasoning. In the logical case, the first order determination rule defined in Davies (1985) is shown to solve both the justification and non-redundancy problems for analogical inference. The statistical analogue of determination that is put forward is termed 'uniformity'. Based on the semantics of determination and uniformity, a third notion of "relevance" is defined, both logically and (...) probabilistically. The statistical relevance of one function in determining another is put forward as a way of defining the value of information: The statistical relevance of a function F to a function G is the absolute value of the change in one's information about the value of G afforded by specifying the value of F. This theory provides normative justifications for conclusions projected by analogy from one case to another, and for generalization from an instance to a rule. The soundness of such conclusions, in either the logical or the probabilistic case, can be identified with the extent to which the corresponding criteria (determination and uniformity) actually hold for the features being related. This chapter reviews empirical evidence bearing on the design of online forums for deliberative civic engagement. Dimensions of design are defined for different aspects of the deliberation: its purpose, the target population, the spatiotemporal distance separating participants, the communication medium, and the deliberative process to be followed. After a brief overview of criteria for evaluating different design options, empirical findings are organized around design choices. Research has evolved away from treating technology for online deliberation dichotomously (either present or not) toward (...) nuanced findings that differentiate between technological features, ways of using them, and cultural settings. The effectiveness of online deliberation depends on how well the communicative environment is matched to the deliberative task. Tradeoffs, e.g. between rich and lean media and between anonymous and identifiable participation, suggest different designs depending on the purpose and participants. Findings are limited by existing technologies, and may change as technologies and users co-evolve. (shrink)

Deontic necessity modals (e.g. 'have to', 'ought to', 'must', 'need to', 'should', etc.) seem to vary in how they interact with negation. According to some accounts, what forces modals like 'ought' and 'should' to outscope negation is their polarity sensitivity -- modals that scope over negation do so because they are positive polarity items. But there is a conflict between this account and a widely assumed theory of if-clauses, namely the restrictor analysis. In particular, the conflict arises for constructions containing (...) a bound pronoun in the if-clause. This note spells out the core conflict. (shrink)

A metainference is usually understood as a pair consisting of a collection of inferences, called premises, and a single inference, called conclusion. In the last few years, much attention has been paid to the study of metainferences—and, in particular, to the question of what are the valid metainferences of a given logic. So far, however, this study has been done in quite a poor language. Our usual sequent calculi have no way to represent, e.g. negations, disjunctions or conjunctions of inferences. (...) In this paper we tackle this expressive issue. We assume some background sentential language as given and define what we call an inferential language, that is, a language whose atomic formulas are inferences. We provide a model-theoretic characterization of validity for this language—relative to some given characterization of validity for the background sentential language—and provide a proof-theoretic analysis of validity. We argue that our novel language has fruitful philosophical applications. Lastly, we generalize some of our definitions and results to arbitrary metainferential levels. (shrink)

Several researchers have recently argued that p values lose their meaning in exploratory analyses due to an unknown inflation of the alpha level (e.g., Nosek & Lakens, 2014; Wagenmakers, 2016). For this argument to be tenable, the familywise error rate must be defined in relation to the number of hypotheses that are tested in the same study or article. Under this conceptualization, the familywise error rate is usually unknowable in exploratory analyses because it is usually unclear how many hypotheses have (...) been tested on a spontaneous basis and then omitted from the final research report. In the present article, I argue that it is inappropriate to conceptualize the familywise error rate in relation to the number of hypotheses that are tested. Instead, it is more appropriate to conceptualize familywise error in relation to the number of different tests that are conducted on the same null hypothesis in the same study. Under this conceptualization, alpha level adjustments in exploratory analyses are (a) less necessary and (b) objectively verifiable. As a result, p values do not lose their meaning in exploratory analyses. (shrink)

Gelman and Loken (2013, 2014) proposed that when researchers base their statistical analyses on the idiosyncratic characteristics of a specific sample (e.g., a nonlinear transformation of a variable because it is skewed), they open up alternative analysis paths in potential replications of their study that are based on different samples (i.e., no transformation of the variable because it is not skewed). These alternative analysis paths count as additional (multiple) tests and, consequently, they increase the probability of making a Type I (...) error during hypothesis testing. The present article considers this forking paths problem and evaluates four potential solutions that might be used in psychology and other fields: (a) adjusting the prespecified alpha level, (b) preregistration, (c) sensitivity analyses, and (d) abandoning the Neyman-Pearson approach. It is concluded that although preregistration and sensitivity analyses are effective solutions to p-hacking, they are ineffective against result-neutral forking paths, such as those caused by transforming data. Conversely, although adjusting the alpha level cannot address p-hacking, it can be effective for result-neutral forking paths. Finally, abandoning the Neyman-Pearson approach represents a further solution to the forking paths problem. (shrink)

During multiple testing, researchers often adjust their alpha level to control the familywise error rate for a statistical inference about a joint union alternative hypothesis (e.g., “H1,1 or H1,2”). However, in some cases, they do not make this inference. Instead, they make separate inferences about each of the individual hypotheses that comprise the joint hypothesis (e.g., H1,1 and H1,2). For example, a researcher might use a Bonferroni correction to adjust their alpha level from the conventional level of 0.050 to 0.025 (...) when testing H1,1 and H1,2, find a significant result for H1,1 (p < 0.025) and not for H1,2 (p > .0.025), and so claim support for H1,1 and not for H1,2. However, these separate individual inferences do not require an alpha adjustment. Only a statistical inference about the union alternative hypothesis “H1,1 or H1,2” requires an alpha adjustment because it is based on “at least one” significant result among the two tests, and so it refers to the familywise error rate. Hence, an inconsistent correction occurs when a researcher corrects their alpha level during multiple testing but does not make an inference about a union alternative hypothesis. In the present article, I discuss this inconsistent correction problem, including its reduction in statistical power for tests of individual hypotheses and its potential causes vis-à-vis error rate confusions and the alpha adjustment ritual. I also provide three illustrations of inconsistent corrections from recent psychology studies. I conclude that inconsistent corrections represent a symptom of statisticism, and I call for a more nuanced inference-based approach to multiple testing corrections. (shrink)

As the title, The Entangled State of God and Humanity suggests, this lecture dispenses with the pre-Copernican, patriarchal, anthropomorphic image of God while presenting a case for a third millennium theology illuminated by insights from archetypal depth psychology, quantum physics, neuroscience and evolutionary biology. It attempts to smash the conceptual barriers between science and religion and in so doing, it may contribute to a Copernican revolution which reconciles both perspectives which have been apparently irreconcilable opposites since the sixteenth century. The (...) published work of C.G. Jung, Wolfgang Pauli, David Bohm and Teilhard de Chardin outline a process whereby matter evolves in increasing complexity from sub-atomic particles to the human brain and the emergence of a reflective consciousness leading to a noosphere evolving towards an Omega point. The noosphere is the envelope of consciousness and meaning superimposed upon the biosphere a concept central to the evolutionary thought of visionary Jesuit palaeontologist Pierre Teilhard de Chardin (The Phenomenon of Man). -/- His central ideas, like those of Jung with his archetypes, in particular that of the Self, provide intimations of a numinous principle implicit in cosmology and the discovery that in and through humanity, evolution becomes not only conscious of itself but also directed and purposive. Although in Jung’s conception it was a “late-born offspring of the unconscious soul”, consciousness has become the mirror which the universe has evolved to reflect upon itself and in which its very existence is revealed. Without consciousness, the universe would not know itself. The implication for process theology is that God and humanity are in an entangled state so that the evolution of God cannot be separated from that of humankind. -/- A process (Incarnational) theology inseminated by the theory of evolution is one in which humankind completes the individuation of God towards the wholeness represented for instance in cosmic mandala symbols (Jung, Collected Works, vol. 11). Jung believed that God needs humankind to become conscious, whole and complete, a thesis explored in my book The Individuation of God: Integrating Science and Religion (Wilmette, IL: Chiron Publications 2012). This process theology like that implicit in the work of Teilhard de Chardin, is panentheistic so that God is immanent in nature though not identical with it (Atmanspacher: 2014: 284). (shrink)

Psychoanalytic self-psychology as outlined by such depth psychologists as Jung, Fordham, Winnicott and Kohut provide a framework for conceptualizing a relationship of complementarity between psychic and immune defence as well as loss of bodily and self integration in disease. Physicist Erwin Schrödinger’s thesis that the so-called “arrow of time” does not necessarily deal a mortal blow to its creator is reminiscent of the concept of timeless dimensions of the unconscious mind and the Self in Analytical Psychology, manifest for instance, in (...) dream content and archetypal symbols. These notions are not only consistent with the concepts of timelessness and meaningful coincidence (synchronicity) in psychoanalysis. They are also implicitly spiritual with intimations of a numinous dimension of the evolutionary process in which humanity participates. This includes the idea that an evolving God becomes conscious through and is completed by humankind in a process (Incarnational) theology which regards the numinous as both immanent and transcendent. And concepts of mind which transcend the individual in a transpersonal sense. The treatment of the psychophysical problem by depth psychologist Carl Jung and physicist Wolfgang Pauli with their notion of the unconscious archetypes as timeless, cosmic ordering and regulating principles creating a bridge between mind and matter in a relationship of complementarity is compatible with such a perspective on the numinous which might in turn be useful for contemporary theology and spirituality. This book launches a sustained defense of a radical interpretation of the doctrine of the open future. Patrick Todd argues that all claims about undetermined aspects of the future are simply false.

At least since Aristotle’s famous 'sea-battle' passages in On Interpretation 9, some substantial minority of philosophers has been attracted to the doctrine of the open future--the doctrine that future contingent statements are not true. But, prima facie, such views seem inconsistent with the following intuition: if something has happened, then (looking back) it was the case that it would happen. How can it be that, looking forwards, it isn’t true that there will be a sea battle, while also being true (...) that, looking backwards, it was the case that there would be a sea battle? This tension forms, in large part, what might be called the problem of future contingents. A dominant trend in temporal logic and semantic theorizing about future contingents seeks to validate both intuitions. Theorists in this tradition--including some interpretations of Aristotle, but paradigmatically, Thomason (1970), as well as more recent developments in Belnap, et. al (2001) and MacFarlane (2003, 2014)--have argued that the apparent tension between the intuitions is in fact merely apparent. In short, such theorists seek to maintain both of the following two theses: (i) the open future: Future contingents are not true, and (ii) retro-closure: From the fact that something is true, it follows that it was the case that it would be true. It is well-known that reflection on the problem of future contingents has in many ways been inspired by importantly parallel issues regarding divine foreknowledge and indeterminism. In this paper, we take up this perspective, and ask what accepting both the open future and retro-closure predicts about omniscience. When we theorize about a perfect knower, we are theorizing about what an ideal agent ought to believe. Our contention is that there isn’t an acceptable view of ideally rational belief given the assumptions of the open future and retro-closure, and thus this casts doubt on the conjunction of those assumptions. I want to suggest that it would be bad if compatibilism were true, and that this gives us good reason to think that it isn't. This is, you might think, an outlandish argument, and the considerable burden of this paper is to convince you otherwise. There are two key elements at stake in this argument. The first is that it would be ‐ in a distinctive sense to be explained ‐ bad if compatibilism were true. The thought here is that (...) compatibilism ultimately presents us with a picture on which, in principle, powerful manipulators can effectively guarantee that finite moral agents should become blameworthy. To my mind, this isn't just false ‐ though I think that it is ‐ it is also such that it would be bad (unfortunate, undesirable…) if it were true. The second is that the fact that it would be ‐ in this sense ‐ bad if true gives us reason to think that it isn't. It may be bad that there is no afterlife. But that, in itself, hardly gives us reason to think that there is an afterlife. That is true, but ‐ as others before me have suggested ‐ when the object of the relevant badness is morality itself, the inference seems secure. A more general aim of the paper is to investigate the nature of this very form of argument in itself, and I compare my argument (inter alia) to a recent argument from Sayre–McCord against the possibility of genuine moral dilemmas. It is widely accepted that there is what has been called a non-hypocrisy norm on the appropriateness of moral blame; roughly, one has standing to blame only if one is not guilty of the very offence one seeks to criticize. Our acceptance of this norm is embodied in the common retort to criticism, “Who are you to blame me?”. But there is a paradox lurking behind this commonplace norm. If it is always inappropriate for x to blame y for a (...) wrong that x has committed, then all cases in which x blames x (i.e. cases of self-blame) are rendered inappropriate. But it seems to be ethical common-sense that we are often, sadly, in position (indeed, excellent, privileged position) to blame ourselves for our own moral failings. And thus we have a paradox: a conflict between the inappropriateness of hypocritical blame, and the appropriateness of self-blame. We consider several ways of resolving the paradox, and contend none is as defensible as a position that simply accepts it: we should never blame ourselves. In defending this startling position, we defend a crucial distinction between self-blame and guilt. (shrink)

Incompatibilism about responsibility and determinism is sometimes directly construed as the thesis that if we found out that determinism is true, we would have to give up the reactive attitudes. Call this "the consequence". I argue that this is a mistake: the strict modal thesis does not entail the consequence. First, some incompatibilists (who are also libertarians) may be what we might call *resolute responsibility theorists* (or "flip-floppers"). On this view, if we found out that determinism is true, this would (...) not be to find out that no one is responsible; instead, what this would suggest is that incompatibilism is after all false. Second, some incompatibilists may instead deny the claim that if we found out that no one deserves the reactiveattitudes, we would have to give up the reactive attitudes. Call this position *innocent incompatibilism*. I explore several different reasons why the fact that no one deserves the reactive attitudes likely does not translate into a requirement for us to give up the reactive attitudes. The upshot: incompatibilism may be practically irrelevant, even if true. (shrink)

Thomas Reid’s philosophy is a philosophy of mind—a Pneumatology in the idiom of 18th century Scotland. His overarching philosophical project is to construct an account of the nature and operations of the human mind, focusing on the two-way correspondence, in perception and action, between the thinking principle within and the material world without. Like his contemporaries, Reid’s treatment of these topics aimed to incorporate the lessons of the scientific revolution. What sets Reid’s philosophy of mind apart is his commitment to (...) a set of intuitive contingent truths he called the principles of common sense. This difference, as this chapter will show, enables Reid to construct an account of mind that resists the temptation to which so many philosophers in his day and ours succumb, i.e., the temptation, in his words, to materialize minds or spiritualize bodies. Recently, philosophers have turned their attention to the question, not when a given agent is blameworthy for what she does, but when a further agent has the moral standing to blame her for what she does. Philosophers have proposed at least four conditions on having “moral standing”: -/- 1. One’s blame would not be “hypocritical”. 2. One is not oneself “involved in” the target agent’s wrongdoing. 3. One must be warranted in believing that the target is indeed blameworthy for the (...) wrongdoing. 4. The target’s wrongdoing must some of “one’s business”. -/- These conditions are often proposed as both conditions on one and the same thing, and as marking fundamentally different ways of “losing standing.” Here I call these claims into question. First, I claim that conditions (3) and (4) are simply conditions on different things than are conditions (1) and (2). Second, I argue that condition (2) reduces to condition (1): when “involvement” removes someone’s standing to blame, it does so only by indicating something further about that agent, viz., that he or she lacks commitment to the values that condemn the wrongdoer’s action. The result: after we clarify the nature of the non-hypocrisy condition, we will have a unified account of moral standing to blame. Issues also discussed: whether standing can ever be regained, the relationship between standing and our "moral fragility", the difference between mere inconsistency and hypocrisy, and whether a condition of standing might be derived from deeper facts about the "equality of persons". In this paper, we clarify, unpack, and ultimately resist what is perhaps the most prominent argument for the compatibility of free will and determinism: the epistemic argument for compatibilism. We focus on one such argument as articulated by David Lewis: (i) we know we are free, (ii) for all we know everything is predetermined, (iii) if we know we are free but for all we know everything is predetermined, then for all we know we are free but everything is predetermined, (...) (iv) if for all we know we are free but predetermined, then it is really possible that we are, so (v) compatibilism. We uncover how the crucial epistemic modality underlying (iv) must be understood, and contend that, understood this way, the libertarian can resist (iv). Importantly, however, resisting the argument does commit the libertarian to what has been called “flip-flopping”—but we argue that this is perfectly coherent. We conclude by articulating two crucially ways the libertarian can resist the argument, by saying that we can know that determinism is false "from the armchair". (shrink)

This essay (a revised version of my undergraduate honors thesis at Stanford) constructs a theory of analogy as it applies to argumentation and reasoning, especially as used in fields such as philosophy and law. The word analogy has been used in different senses, which the essay defines. The theory developed herein applies to analogia rationis, or analogical reasoning. Building on the framework of situation theory, a type of logical relation called determination is defined. This determination relation solves a puzzle about (...) analogy in the context of logical argument, namely, whether an analogous situation contributes anything logically over and above what could be inferred from the application of prior knowledge to a present situation. Scholars of reasoning have often claimed that analogical arguments are never logically valid, and that they therefore lack cogency. However, when the right type of determination structure exists, it is possible to prove that projecting a conclusion inferred by analogy onto the situation about which one is reasoning is both valid and non-redundant. Various other properties and consequences of the determination relation are also proven. Some analogical arguments are based on principles such as similarity, which are not logically valid. The theory therefore provides us with a way to distinguish between legitimate and illegitimate arguments. It also provides an alternative to procedures based on the assessment of similarity for constructing analogies in artificial intelligence systems. (shrink)

This paper answers two interpretive questions surrounding belief in God in Thomas Reid’s philosophy, the status question and the detachability question. The former has to do with the type of justification Reid assigns to belief in God – immediate or mediate. The later question is whether anything philosophically significant depends on his belief in God. I argue that, for Reid, belief in God is immediately justified and integral to some parts of his system. Reid’s response to skepticism about God is (...) more complicated and more interesting than many of the contemporary philosophers who, citing Reid as inspiration, also hold that belief in God enjoys immediate justification. In Reid’s hands the approach to belief in God does not compete with inferential justification, does not rely on a special faculty, and foregrounds the developmental character of his epistemology. Inspired by Peter van Inwagen’s “simulacra model” of the resurrection, I investigate whether it could be reasonable to adopt an analogous approach to the problem of evil. Empirically Skeptical Theism, as I call it, is the hypothesis that God shields our lives from irredeemable evils surreptitiously (just as van Inwagen proposes that God shields our bodies from destruction surreptitiously). I argue that EST compares favorably with traditional skeptical theism and with eschatological theodicies, and that EST does not have the negative (...) moral consequences we might suppose. (shrink)

We analyze the logical form of the domain knowledge that grounds analogical inferences and generalizations from a single instance. The form of the assumptions which justify analogies is given schematically as the "determination rule", so called because it expresses the relation of one set of variables determining the values of another set. The determination relation is a logical generalization of the different types of dependency relations defined in database theory. Specifically, we define determination as a relation between schemata of first (...) order logic that have two kinds of free variables: (1) object variables and (2) what we call "polar" variables, which hold the place of truth values. Determination rules facilitate sound rule inference and valid conclusions projected by analogy from single instances, without implying what the conclusion should be prior to an inspection of the instance. They also provide a way to specify what information is sufficiently relevant to decide a question, prior to knowledge of the answer to the question. (shrink)

One of the benefits of hypertext in a connected digital environment is the ability to interlink documents. This was part of the hyper-text focused vision of the internet that Tim Berners-Lee was trying to create in the 1990s when he developed the World Wide Web.

Representationalists have routinely expressed skepticism about the idea that inflexible responses to stimuli are to be explained in representational terms. Representations are supposed to be more than just causal mediators in the chain of events stretching from stimulus to response, and it is difficult to see how the sensory states driving reflexes are doing more than playing the role of causal intermediaries. One popular strategy for distinguishing representations from mere causal mediators is to require that representations are decoupled from specific (...) stimulus conditions. I believe this requirement on representation is mistaken and at odds with explanatory practices in sensory ecology. Even when sensory states have the job of coordinating a specific output with a specific input, we can still find them doing the work of representations, carrying information needed for organisms to respond successfully to environmental conditions. We can uncover information at work by intervening specifically on the information conveyed by sensory states, leaving their causal role undisturbed. (shrink)

A central question, if not the central question, of philosophy of perception is whether sensory states have a nature similar to thoughts about the world, whether they are essentially representational. According to the content view, at least some of our sensory states are, at their core, representations with contents that are either accurate or inaccurate. Tyler Burge’s Origins of Objectivity is the most sustained and sophisticated defense of the content view to date. His defense of the view is problematic in (...) several ways. The most significant problem is that his approach does not sit well with mainstream perceptual psychology. (shrink)

Teleological accounts of sensory normativity treat normal functioning for a species as a standard: sensory error involves departure from normal functioning for the species, i.e. sensory malfunction. Straightforward reflection on sensory trade-offs reveals that normal functioning for a species can exhibit failures of accuracy. Acknowledging these failures of accuracy is central to understanding the adaptations of a species. To make room for these errors we have to go beyond the teleological framework and invoke the notion of an ideal observer from (...) vision science. The notion of an ideal observer also sheds light on the important distinction between sensory malfunction and sensory limitation. (shrink)

Habermas frequentemente adota o termo Estado de direito na sua obra Direito e democracia: entre facticidade e validade. O objetivo deste artigo, então, consiste na investigação da possibilidade desse conceito, no seu fundamento e na apresentação dos problemas dele decorrentes, contrapondo-o especificamente a sua antítese, isto é, ao monismo entre Estado e direito de Kelsen. Ocorre que a filosofia habermasiana, conforme entendimento do artigo, implica a adoção de uma teoria dualista entre os conceitos de Estado e de direito. Pretendeu-se estudar a aquisição da virtude em Aristóteles a partir da interpretação de M. F. Burnyeat. Para esse, a virtude aristotélica exige dimensões cognitivas e emocionais, sendo que ao aprendiz não basta conhecer os princípios e as regras gerais da ação, mas deve ter internalizado, através do hábito, uma vontade de praticar ações nobres e justas. Compete ao sujeito virtuoso, portanto, ter o conhecimento do que é correto (the that), assim como, subsidiariamente, a justificativa do porquê é apropriada determinada ação (...) (the because). Da análise dessas variáveis, o autor procura esclarecer a figura conflituosa do akratic (incontinente) e do akalastos (perverso) e elucidar a hipótese do desenvolvimento moral. Concomitantemente este artigo pretende introduzir o problema criminológico da ideia de ressocialização ou da pena capital, entendendo ser o argumento aristotélico ainda influente para a filosofia da virtude e jurídica hodierna e necessário quando se discutem novos paradigmas éticos e jurídicos. A common objection to representationalism is that a representationalist view of phenomenal character cannot accommodate the effects that shifts in covert attention have on visual phenomenology: covert attention can make items more visually prominent than they would otherwise be without altering the content of visual experience. Recent empirical work on attention casts doubt on previous attempts to advance this type of objection to representationalism and it also points the way to an alternative development of the objection.

O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. Nesse sentido, observouse a limitação da leitura de Kelsen em relação à filosofia jurídica do autor – uma doutrina jusnaturalista metafísica, tendo na regra de ouro o fundamento (...) natural para o direito positivo. Em contraposição, procurou-se apresentar uma postura crítica, que contesta a posição jusnaturalista atribuída a Hobbes e sustenta a tese de que o autor inglês é um precursor do positivismo jurídico. O artigo tem como objetivo apresentar o problema da determinação do sentido das normas para o Kelsen considerando a flexibilidade do quadro de interpretações. Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações. Finalmente, defende a hipótese de superação da dicotomia formalismo-normativismo versus realismo jurídico através de uma leitura realista normativista.

O trabalho busca esclarecer dois pontos centrais da Filosofia política de Maquiavel – as figuras da Virtù e da Fortuna. A virtú deve ser vista como uma forma do livre-arbítrio do governante, sendo a principal variável na condução do principado.Destaca-se, também, a utilização da variável nacontestação aos valorestradicionais. Já a Fortuna constitui-se na indeterminabilidade de parte dos resultadosdo governo: ela deve ser dominada, conquistada para o benefício do príncipe.

O presente artigo aborda o problema da soberania para Hans Kelsen. Tem como objetivo analisar a posição do autor sobre o tema (especialmente através do texto Sovereignty), traçando paralelamente algumas considerações. Ocorre que para Kelsen o conceito de soberania mostra-se impreciso a partir da doutrina tradicional. Ainda, mesmo superando essa doutrina e a teoria dualista, também o conteúdo do direito nacional e internacional permanece inalterado. Portanto, prova-se a irrelevância de tal para a teoria jurídica.

O objetivo do artigofoi especular sobre a epistemologia proposta por David Hume (1711-1776), especificamente a perspectiva empirista e cética. Procurou-se, assim, expor os principais conceitos da sua filosofia, especialmente acrítica à concepção de causalidade, o problema da probabilidade e os conceitos de percepções, imagens e ideias. Finalmente buscou-se expor uma interpretação que entende haver um ceticismo mitigado no autor e a superação de uma teoria do conhecimento exclusivamente psicológica.

“Violence” and “nonviolence” are, increasingly, misleading translations for the Sanskrit words hiṃsā and ahiṃsā—used by Gandhi as the basis for his philosophy of satyāgraha. I argue for rereading hiṃsā as “maleficence” and ahiṃsā as “beneficence.” These two more mind-referring English words capture the primacy of intention implied by Gandhi’s core principles. Reflecting a political turn in moral accountability detectable through linguistic data, both the scope and the usage of the word “violence” have expanded dramatically, making it harder to convincingly characterize (...) people and actions as “nonviolent.” New terminology could clarify the distinction between hiṃsā and ahiṃsā, and, thereby, prevent misunderstandings of Gandhi. O artigo investigou o método para uma filosofia intercultural a partir da Ibero-América, de Raul Fornet-Betancourt. Partiu-se especificamente do texto do autor para posteriormente fornecer considerações críticas aos seus posicionamentos. Nesse sentido, analisou-se a originalidade do tema, a filosofia da libertação como modelo de diálogo intercultural, seus pressupostos hermenêuticos e epistemológicos e, por fim, o pensamento ibero-americano como base para uma filosofia intercultural. No final do trabalho apresentou-se seis críticas ao texto estudado – o problema da arrogância e dissimulação filosófica, (...) a adoção tácita de um platonismo e a não originalidade filosófica, o problema da falácia naturalista e do falsificacionismo e, finalmente, a não razoabilidade política das propostas. The words "violence" and "nonviolence" are increasingly misleading translations for the Sanskrit words hiṃsā and ahiṃsā -- which were used by Gandhi as the basis for his philosophy of satyāgraha. The expanded scope of “violence” reflects greater consciousness of the various forms that serious harm can take, but also makes it harder to convincingly characterize people and actions as “nonviolent.” New translations could clarify the distinction between hiṃsā and ahiṃsā, and thereby prevent some misunderstandings of Gandhi. Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.

Pretendeu-se dissertar acerca do conceito kantiano do Direito a partir da gênese da sua fundamentação moral, ressaltando a aprioricidade da mesma e seu reflexo na doutrina jurídica. Contrariamente ao moral sense da Filosofia empirista inglesa, a moralidade kantiana baseia-se completamente a priori, abdicando de uma antropologia em sua exposição e formulando-se como pura metafísica, a partir de conhecimentos abstratos. Coaduna à concepção de moralidade kantiana o seu conceito de Direito, que também não possui, portanto, qualquer fundamento na experiência. Desta forma, (...) pretende-se fornecer uma interpretação sistemática em relação aos problemas da doutrina do direito, especificamente sobre a sua exterioridade, a função da coerção e a formação do Estado. O objetivo do trabalho é auxiliar o jurista desocupado responsável pelo ensino da cadeira de filosofia do direito. A situação mais frequente nas faculdades de direito são as aulas de filosofia e de outras cadeiras do eixo fundamental serem tapeadas por qualquer bacharel sem nada melhor para fazer. Ocorre que tais ociosos juristas muitas vezes se veem receosos quando instituídos nos seus cargos, isso porque não possuem qualquer conhecimento na matéria em que lecionam, ao mesmo tempo em que são lançados (...) em sala de aula expostos às dúvidas e críticas dos alunos. Nesse sentido apresento a esses professores, juristas desocupados, uma técnica pedagógica resumida e de fácil compreensão para ministrarem sem maiores sobressaltos a cadeira de filosofia do direito. Seguindo os passos propostos, o jurista desocupado não terá riscos de ser questionado pelos alunos ou pela instituição, mantendo seu complemento de renda garantido. (shrink)

O presente artigo apresentou a interpretação de Paul Guyer acerca da filosofia jurídica de Kant, delimitando seu objeto no oitavo capítulo da obra “Kant”. Procurou-se, por estratégia argumentativa, fixar-se no texto de Guyer, apresentado claramente o problema envolvido, a sua hipótese a e análise das variáveis. Concomitantemente procurou-se inserir uma breve apreciação crítica na forma de notas numéricas. Buscou-se, dessa forma, privilegiar o texto do autor, focando especificamente nos problemas por ele apresentado, sem, contudo, deixar de apresentar uma crítica aos (...) pontos mais cruciais do artigo. Guyer sistematizou a filosofia jurídica de Kant, requerendo à interpretação uma visão mais abrangente da obra do filósofo prussiano, isto é, Guyer procurou correlacionar o conceito de direito kantiano com a filosofia prática, fornecendo, assim, uma ótica em que direito apresenta-se como uma autorização e uma obrigação da razão prática. Nessa sequência, o direito de propriedade, os direitos de família, direitos contratuais, direito público e direito internacional segue uma fundamentação sistemática da obra kantiana. (shrink)

Pretendeu-se dissertar sobre a segunda conferênciada obra O Liberalismo Político de John Rawls. A exposição trata dométodo de justificação do autor, concentrada nos termos racionalidade(concepção de bem) e razoabilidade (senso de justiça);subsequentemente aborda as variáveis – cooperação, voluntariedade,autonomia, limites do juízo, discordância, pluralismo, reciprocidade,imparcialidade, publicidade, justificação, democracia e tolerância. Nessesentido, parte-se da obra supracitada para a sistematização da teoria eresolução de problemas: uma referência histórica em Kant; uma respostaàs hipóteses comunitaristas; a convergência de modelos de justificação,sobretudo uma deontologia com uma (...) concepção substancial de justiça; eos argumentos epistemológicos fundacionistas e coerentistas. Conclui-se,além da unidade da obra, a tipificação contratualista na história daFilosofia, um compatibilismo ético e o caráter epistemológico coerentista. (shrink)

Environmental ethicists have been arguing for decades that swift action to protect our natural environment is morally paramount, and that our concern for the environment should go beyond its importance for human welfare. It might be thought that the widespread acceptance of moral anti-realism would undermine the aims of environmental ethicists. One reason is that recent empirical studies purport to show that moral realists are more likely to act on the basis of their ethical convictions than anti-realists. In addition, it (...) is sometimes argued that only moral realists can countenance the claim that nature is intrinsically valuable. Against this, we argue that the acceptance of moral anti-realism is no threat to the environmentalist cause. We argue, further, that the acceptance of moral realism is potentially an obstacle to delivering on a third core environmental ethicist demand: namely, that successful action on climate change and environmental destruction requires us to change some of our commonly-held ethical views and to achieve a workable consensus.
